1. Scope

These Terms & Conditions (“Terms”) apply to all purchases made via promptyouravatar.com (“Website”).

The Website is operated by Christopher Köhler (“we”, “us”).

If you purchase as a business, you confirm you are acting in the course of trade, business or profession (“Business Customer”).

2. Products

We sell digital products (e.g., PDF downloads, digital files, prompt packs) (“Digital Content”). No physical shipping is provided.

3. Contract formation

By placing an order and completing payment, you make a binding offer to purchase. A contract is formed when we confirm the order or provide access to the Digital Content (e.g., via download link / customer account / email).

4. Prices & taxes

All prices are shown on the Website. Taxes (if applicable) are displayed during checkout.

5. Payment methods & payment processing

We accept payment via PayPal and card payments processed through Stripe / WooPayments (WooPayments is integrated with Stripe).

To process payments and prevent fraud, your payment details may be handled by these payment providers according to their terms and privacy policies. We do not store full card details on our servers.

If a payment is reversed (e.g., chargeback/dispute), we may suspend access to the Digital Content until the issue is resolved.

6. Delivery / access

Digital Content is delivered electronically (download link / account access) after successful payment. You are responsible for ensuring you can open and use the files (internet connection, compatible software, sufficient storage).

7. License & permitted use

Unless explicitly stated otherwise, you receive a non-exclusive, non-transferable license to use the Digital Content for your own purposes.

You must not:

• share, resell, sublicense, distribute, or publish the Digital Content (in whole or in part),

• make the Digital Content available to the public (including upload to file-sharing platforms),

• remove copyright/trademark notices.

Business Customers: If you need multi-user or client usage, contact us for a commercial license.

8. Updates

We may update or improve Digital Content (e.g., corrections, formatting, additions). If you purchased a version, access to updates is provided only if stated on the product page.

9. Right of Withdrawal (consumers only)

If you are a consumer in the EU/EEA/UK, you generally have a 14-day right of withdrawal for distance contracts.

Important for Digital Content: your right of withdrawal can expire once you request immediate delivery and acknowledge the loss of the withdrawal right. Business Customers do not have a statutory right of withdrawal.

10. Refunds / defects

Due to the nature of Digital Content, refunds are generally excluded once access/download is provided, unless:

• the file is defective/corrupt and we cannot provide a working replacement, or

• mandatory consumer law requires otherwise.

11. Liability

We are liable for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations and limited to foreseeable damages typical for the contract.

We are not liable for compatibility issues on your device/software if the product requirements are met and the issue lies outside our control.

Nothing in these Terms limits liability where it cannot be excluded under mandatory law.

12. Governing law & jurisdiction

These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, mandatory consumer protections of your country of residence remain unaffected.

If you are a Business Customer, the place of jurisdiction is Berlin, Germany.
